Clark County isn’t ready to abandon the legal fight to revive its 2004 casino agreement with the Cowlitz Tribe.
Commissioners, after meeting behind closed doors for the fourth time to mull legal options and strategies, voted 2-1 Friday to file a “placeholder” appeal the county could opt to withdraw or proceed with at a later date.
Commissioner Marc Boldt cast the lone dissenting vote. In the past, Boldt has said he would have not signed the county-tribe memorandum of understanding, or MOU, if he had been in office when it was approved.
A state hearings board invalidated the MOU last June because the county had not complied with state law requiring early and continuous public participation in what has been judged to be a growth management decision.
The county tried to reverse that decision in court, but Thurston County Superior Court Judge Gary Tabor rejected an appeal in December.
